BACKGROUND:  House Bill 1500 (as passed by the house and senate), was sponsored by Representative Wilkerson of the 38th District. The bill was to be entitled to amend an Act creating a new charter for the City of Powder Springs, approved March 13, 2 1970 (Ga. L. 1970, p. 2760), as amended, so as to adopt by reference a certain map to update the boundaries of the city; to provide for related matters; to repeal conflicting laws; and for other purposes.

ANALYSIS:

The application was reviewed against the following criteria:

 

 

a.                     Whether the proposed zoning district and uses within that district are compatible with the purpose and intent of the comprehensive plan. The future development map and the future land use plan map of the city’s comprehensive plan shall be used in decision making relative to amendments to the official zoning map.

The City of Powder Springs’ 2021 Comprehensive Plan’s Annexation Plan element has a goal to reduce unincorporated islands, and to expand the incorporated limits of the city.

 

b.                     Whether the proposed zoning district and uses permitted within that district are suitable in view of the zoning and development of adjacent and nearby property.

The proposed zoning district aligns with the existing county zoning. No changes in uses are proposed.

 

c.                     Whether the existing use or usability of adjacent or nearby property will adversely affected by one or more uses permitted in the requested zoning district.

The proposed zoning district aligns with the existing county zoning. No changes in uses are proposed.

 

d.                     Whether there are substantial reasons why the property cannot or should not be used as currently zoned.

 

The proposed zoning district aligns with the existing county zoning. No changes in uses are proposed.

 

e.                     Whether public facilities such as roads, schools, water and sewer utilities, and police and fire protection will be adequate to serve the proposed zoning district and uses permitted.

 

Existing public infrastructure facilities and services are adequate.

f.                     Whether the proposed zoning district and uses permitted within that zoning district are supported by new or changing conditions not anticipated by the comprehensive plan or reflected in the existing zoning on the property or surrounding properties.

 

The comprehensive plan’s annexation plan elements envisioned the city annexing unincorporated properties across the city.

 

g.                     Whether the proposed zoning district and uses permitted within that zoning district reflect a reasonable balance between the promotion of the public health, safety, morality or general welfare and the right to unrestricted use of property.

                     

The proposed zoning district aligns with the existing county zoning. No changes in uses are proposed.

 

 

 

STAFF RECOMMENDATION: APPROVAL.
