Recommendation:
Approval of the final plat with conditions:
1) Receipt of subdivision improvement guarantees, including installation of street lights.
2) Any outstanding staff comments are addressed to meet the requirements of the Unified Development Code.
3) Model home permits for one building may be issued prior to the recordation of the final plat.
Background:
The subject property is currently is under construction by Kerley Family Homes and is located in the Silverbrooke subdivision on Elliott Road. The property is zoned Mixed Use (MXU) and is part of a larger MXU development containing commercial uses, single family residential homes, and additional undeveloped land for future commercial activity on the eastern side of Elliott Road and US Highway 278. The original rezoning was granted for this property on January 5, 2004. Additional approvals were granted by the Mayor and City Council on December 29, 2004 and January 5, 2005. The Mayor and City Council approved revised stipulations on February 20, 2006, which superseded all previously approved stipulations. On July 17, 2006 and February 4, 2008 the February 20, 2006 stipulations were amended regarding playing fields and the swimming pool. On November 11, 2011 and July 23, 2012 changes of zoning were approved regarding a commercial component of the project. On May 6, 2013, the zoning stipulations were amended regarding houses in Unit 4 of Silverbrooke subdivision (Silverbrooke Reserve) proposed to be built by Peachtree Communities. On October 5, 2015 a stream buffer variance for Unit 3 was approved. Kerley Family Homes completed 3 lots in Unit 1 and is nearly finished with Units 2a and 2b. On January 4, 2016 a change in zoning was approved to allow either townhouses or single family houses on the subject property.
Fiscal Impact:
The subdivision is partially developed with single family houses. Kerley Family Homes is developing Unit 5 of the subdivision, and renaming it the Villas at West Cobb. Development of the site and construction of the proposed homes will not increase demand for public services or impact public infrastructure more that what was already approved by zoning.
Analysis:
A preliminary plat was reviewed and approved by staff on June 27, 2017. A land disturbance permit was issued on 9/19/2017. Work under said permit is almost complete and the next step in the process is the approval of the final plat. After final plat is approved, the applicant will start the construction of townhouses.
The City will require a quote from the contractor regarding the cost to complete the roads. The City staff will review this estimate, and once approved, the code requires that guarantees be received in the form of letters of credit, cash escrow or a certificate of deposit. The guarantee must be received prior to approval of recordation of this final plat.
Dewberry and Associates reviewed the preliminary plat and land disturbance permit for compliance with the floodplain regulations and the final plat. Comments regarding the final plat from Dewberry Engineers were provided to the applicant.
The Unified Development Code requires that the final plat be approved prior to the issuance of a building permit. The builder has requested that a model home permit be issued on the first building prior to recording of the plat. This request is consistent with other surrounding jurisdictions.
