PETITION: The applicant, is requesting a special use approval to allow a truck inspection facility within the LI zoning district.

Background Information:

The applicant is proposing a truck inspection facility at 3180 Florence Road. Currently the code does not allow truck emission facility. A text amendment has been filed concurrently proposing a Special use request for truck emission testing facility within the HI and LI zoning district. The applicant has indicated the tenant will only be doing truck inspection of the cab only. The operation will be conducted to the rear of the property in which the operation will not be visible from the right-of-way.

 

Surrounding Land Use

 

Subject site is surrounded by industrial and residential zoning district and activities. East of the subject site is residential single-family  subdivisions. West, north and south falls within the light industrial zoning  district which currently consists of industrial and office uses.

 

 

Zoning and Surrounding Uses

Analysis:    

Special Use approval requests are reviewed by criteria set forth in Article 13 of the Unified Development Code. Based on the analysis in this staff recommendation, this application meets the requirements of Special Use Approval, subject to the stipulations provided.

 

 

The application should be reviewed against the following standards: 

 

    a. Will the proposed special use be consistent with the stated purpose of the zoning district in which it will be located?

 

                     According to the Unified Development Code “The LI zoning district is established to provide locations for office, automotive repair, light manufacturing and distribution/service facilities. The LI zoning district does not involve or permit manufacturing establishments which emit smoke, water pollution, or excessive noise such as those resulting from the conversion of raw materials into finished products. Rather, uses permitted uses in the LI zoning district are primarily those that consist of processing, assembling, cleaning, servicing, testing, or repairing of materials, goods or products. Transportation, warehousing, and distribution uses are accommodated as are certain commercial uses supportive of or compatible with other uses permitted in the zoning district.” Allowing truck testing facility in the LI zoning district is consistent with the intent of the UDC.

 

 

      b. Will the establishment of the special use not impede the normal and orderly development of the surrounding property for uses predominate in the area?

 

                     The proposed use will not impede the normal and orderly development of surrounding properties. The building is located in the industrial zoning with adjacent properties that falls within the LI zoning district. The applicant has indicated that the operation will be located to in a rear building that will not by visible from the right-of-way.

 

      c.    Is the location and character of the proposed special use consistent with a desirable pattern of development in general?

 

The subject site is located in the LI zoning district which encourages industrial uses. The subject site is surrounded by industrial activities. The proposed truck emission testing facility will support the surrounding uses and is consistent with the desirable pattern of the surrounding area.  The proposed request is consistent with the requirement of the Unified Development Code.

 

 

      d. Is or will the type of street providing access to the use be adequate to serve the proposed special use?

      

Access to the site is along Florence Road which is a major throughfare. Access to the site appears to be adequate to facility the operation. The applicant has also indicated that the trailer will not be attached upon inspection.  The City has concerns with increase truck traffic along Florence Road and in other areas of the City. If the use is limited in quantity and the trailers are not attached, this will reduce the impact of increased truck traffic.

 

      e. Is or will access into and out of the property be adequate to provide for traffic and pedestrian safety, the anticipated volume of traffic flow, and access by emergency vehicles?

 

This surrounding area is currently an industrial area with tractor trailers moving in and out of this region. This use may cause an increase in truck traffic, however limitations on the use will help limit this increase.

 

f. Are or will public facilities such as schools, water or sewer utilities, and police or fire protection be adequate to serve the special use?

 

The proposed use will not have any impact on school capacity. Impact of water and sewer capacity is anticipated to be minimal. No other public utilities should be negatively affected.

 

      g.  Are or will refuse, service, parking and loading areas on the property be located or screened to protect other properties in the area from such adverse effects as noise, light, glare or odor?

 

Extreme adverse effect is not anticipated. The operation will utilize a building with limited visibility from the right-of-way.

 

h. Will the hours and manner of operation of the special use have no adverse effects on other properties in the area?

 

The proposed hours of operation will be mostly day light hours and should not have an adverse effect on neighboring properties.  The applicant has indicated that the use will be limited to the hours of 7:30am-8pm Monday - Saturday.

 

 

i. Will the height, size or location of the buildings or other structures on the property be compatible with the height, size or location of buildings or other structures on neighboring properties?

 

The existing building is consistent and compatible with surrounding architecture, height and size of other buildings.

 

 

Fiscal Impact:   The proposed request should not have any negative economic impact on the City of Powder Springs as infrastructure and services are already in place to serve the proposed request.

 

Summary and Recommendation:   

 

Staff recommend approval of PZ 21-017 with the following conditions:

 

1.                     This Special Use approval to allow truck emission facility on property located at 3180 Florence Road.

2.                     The hours of operation shall be limited to Monday - Saturday 7:30 am -8:00 pm.

3.                     There shall be no more than 8 inspections per day.

4.                     No truck shall impede traffic on any Right-of-Way.

5.                     Inspections shall occur inside the building. Trailers shall not be attached to the truck at time of inspection.

 

Planning and Zoning Commission Recommended approval on 4/26/2021 with the following conditions:

 

 

1.                      This Special Use approval to allow truck emission facility on property located at 3180 Florence Road.

2.                     The hours of operation shall be limited to Monday - Saturday 7:30 am -7:00 pm. No tests shall start after 6pm.

3.                     There shall be no more than 8 inspections per day.

4.                     No truck shall impede traffic on any Right-of-Way.

5.                     Inspections shall occur outside and to the rear of the building. Trailers shall not be attached to the truck at time of inspection.
