Recommendation:
Approval of application.

Background:
The subject property is located at 4148 Marietta Street. An alcohol license was last issued at this address for Verwayne Enterprises, LLC in 2010. Mr. Patel intends to operate the business, and is applying for an alcohol license in the name of Powder Springs Drive-Thru LLC.


Fiscal Impact:
This location has been vacant for 7 years. The location previously operated as a convenience store with package beer sales. As such, the proposed request will not increase demand for public services or unduly burden public infrastructure. The approval of this request will allow the continuance of beer package sales at the convenience store.

Analysis:
This application complies with Section 3-103 of the Code of Ordinances. This application will be advertised in the Marietta Daily Journal April 20 and April 27 per the requirements of Section 3-113. The property has been posted. There are no taxes owed on this property. The investigation from the Police Department has determined that Mr. Patel does not have outstanding warrants or criminal history in the State of Georgia.

Section 3-120 of the Code of Ordinances states that an application for a new license on an existing licensed location, or on a previously licensed location for a period of one (1) year from expiration of the previous license to the date of application, shall not be required to comply with the distance requirements from a school, church or residence. Because the location has been vacant, it is required to meet distance requirements. The closest house is 320 feet and located on New Macland Road.
