Recommendation:   

Staff recommends a motion to approve of a change in conditions of zoning to remove the prohibition of leasing of units. Staff recommends the allowance of 15% of units be allowed for leasing.

 

 

Background:   

The subject property currently being developed by Douglas Assets/Hollywood Construction with some units occupied. The development is also under the control of the homeowner’s association.  The property is zoned Central Business District (CBD). The original rezoning request on this property occurred on December 1, 2003. The final plat for the property was recorded May 27, 2005 and revised June 10, 2005, November 18, 2019 and August 3, 2021. The subdivision is partially developed with townhouses.

 

Fiscal Impact:   

Upon final build out, the subdivision will be developed with 79 townhouse units. Additionally, no increase in traffic flow to and from the site is anticipated by this application. As such, the proposed use will not increase demand for public services or unduly burden public infrastructure.

 

Analysis:   

One of the zoning stipulations included in the 2003 rezoning was that the development include a prohibition of leasing.

 

The developer is requesting a leasing amount of 30%. City staff has recommended between 12% (10 units) to 15% (12 units) be allowed for leasing. City staff has met with representatives of the Park Place Townhomes HOA. The HOA is comfortable with allowing up to 15%. Once the stipulations are updated, the HOA will take action to update their covenants to match this restriction.
